Trump's First 14th Amendment Challenge to Presidential Bid.

Despite not being charged with rebellion, many Trump detractors and legal professors across the political spectrum believe the former president can be disqualified from the ballot. 

Democratic and Republican voters and officials, represented by the D.C.-based nonprofit and nonpartisan Citizens for Responsibility & Ethics, filed a lawsuit.

Wednesday in Colorado arguing that the 14th Amendment bars Trump from returning to the Oval Office due to his behavior on Jan. 6, 2021.

The lawsuit is based on a post-Civil War clause that bars government officials from taking an oath to uphold the Constitution,

as Trump did at his Jan. 20, 2017, inauguration, and then "engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof".

Lawyers and politicians have discussed invoking the 14th Amendment to keep Trump out of the White House,

but CREW claimed the Colorado case is the first to demand that a state reject Trump from the ballot. 

He says the group chose Colorado because its regulations made it simpler to get it to court.
